我国境内“三非”外国人问题分析

摘　　要：“三非”是带有中国特色的行政术语,“三非”外国人指的是非法入境、非法居留、非法就业的外国人。“三非”外国人管理是目前我国公安出入境实践管理工作的重要内容。“三非”外国人在我国的大量存在,给外国人日常管理工作带来严峻挑战。从法律性质上来看,“三非”外国人不同于非法移民,也有别于难民,因此必须对“三非”外国人的法律地位予以足够重视。《出境入境管理法》加大了对“三非”外国人的处罚力度,有效地维护了国家权益。在“三非”外国人的处置过程中,要注重对“三非”外国人合法权益的保护,同时要采取切实可行的预防措施,有效降低或减少“三非”外国人的数量。“Illegal entry,residence and employment” is an administrative term with obvious Chinese characteristics.“Three Illegal” aliens refer to foreigners involved in illegal entry,residence and employment.At present,illegal aliens-related administration is one of the most important parts of Entry-exit practical administration of public security agencies in China.The large number of “three illegal” aliens in China has brought severe challenges to daily administration of foreigners.By its legal nature,different from illegal immigrants and refugees,the legal status of “three illegal” aliens shall be paid enough attention to.The newly promulgated Exit and Entry Adminstration Law has increased penalties on illegal aliens and effectively safeguarded national rights and interests.In the process of dealing with aliens involved in illegal entry,residence and employment,we should pay attention to protection of the legitimate rights and interests of those aliens and take practical preventive measures to effectively reduce the number of those illegal aliens.
