摘　　要：PCT发明专利申请通常会要求优先权。通过分析在先申请是中国提出的国家申请的PCT发明专利申请的审查过程,揭示在各审查阶段判断优先权成立与否的考虑因素,以期为实质审查过程提供参考。PCT patent applications usually require priority. According to analyze the application of the priority right of the international application was a review process of the national applications filed in China, it revealed the considerations for judging whether or not priority was established at each stage, with a view to providing a reference for the substantive examination.
