高校校规的法律效力研究:基于两种法学流派的考察

摘　　要：高校校规的法律效力问题不仅涉及高校学生管理行为的合法性问题,而且涉及学生合法权利的保障问题。根据实证主义法学派的理论观点,高校校规的法律效力取决于高校校规制定权是否来源于国家权力的授权,这与高校的内在学术逻辑相违背,并不符合高校学术自治的内在要求。根据自然法学派的理论观点,高校校规的法律效力取决于高校所制定的校规在实体方面和程序方面是否合乎理性,是否合乎公平与正义。The legal effect of university regulations not only concerns the legality of students’ behavior management, but also concerns the protection of students’ legal rights. According to the theoretical viewpoint of positivist school of law, the legal effect of university regulations depends on whether the right to make university regulations comes from the authorization of state power, which is contrary to the internal academic logic of universities and does not meet the internal requirements of academic autonomy of universities. According to the theoretical viewpoint of school of natural law, the legal effect of university rules depends on whether the university regulations are rational, as well as whether the university regulations are fair and just in substance and procedure.
