摘 要:能源替代理论来源于新古典经济学替代效应理论,能源替代规范是为了实现能源供应的安全稳定、低碳化、能源结构对可再生能源及清洁能源的使用来替代传统化石能源使用方式进行规范的法律制度,其具有周期性、单向性、双向性、相对性、量变质变性和技术先导性的点。我国经历了油气替代煤炭、非化石能源替代化石能源的历程,在这一过程中暴露出了弊端,所以应当建立我国的能源替代规范法律制度,协调能源替代法律制度与补贴、技术等其他规范法律制度,发挥市场的主导作用,划定政府与市场在能源替代过程的边界,将能源替代规范纳入法治化轨道上来。the theory of energy substitution originates from the theory of substitution effect in neoclassical economics. The energy substitution norm is a legal system to regulate the use of renewable energy and clean energy to replace the traditional fossil energy. It has periodicity, unidirectionality, bidirectionality, relativity, quantitative and qualitative deterioration, and technological precedence. Our country has experienced the process of oil and gas replacing coal and non-fossil energy replacing fossil energy. In this process, the drawbacks have been exposed. Therefore, we should establish the legal system of energy substitution in our country, coordinate the legal system of energy substitution with other legal systems such as subsidies and technologies, give full play to the leading role of the market, delimit the boundary between the government and the market in the process of energy substitution. Source substitution norms are brought into the orbit of legalization.
