摘　　要：采用文献资料法、逻辑分析法分析了欧盟法律和欧盟成员国法律中针对体育赛事知识产权所适用的一些法律工具。研究表明,即使在没有专门针对体育赛事的欧盟协调的情况下,目前的法律框架也能够很好地为体育产业这一领域的投资提供保护。基于传统和新形式的产权、知识产权和同源权利仍然可以为体育组织者提供充分的保护。体育赛事在专门的场馆举行,体育组织者可以要求独家使用权,然后再出具有条件的准入协议。体育赛事的录制和播出可能会牵扯到各种知识产权的问题,特别是在版权及相关权利领域。国家层面采取的特殊形式的保护措施,为体育活动组织者的权利提供了一层额外保护。This article analyses some of the legal tools available to organizers of sporting events under EU law and the law of EU Member States. Research shows that the current legal framework, even in the absence of EU-specific coordination of sporting events, can provide good protection for investments in the field of sports industry. Based on traditional and new forms of property rights, intellectual property and homonymous rights can still provide adequate protection for sport organizers. Many sporting events take place in specialized venues. Sports organizers can claim exclusive rights and then issue conditional access agreements. The recording and broadcasting of sporting events may involve a variety of intellectual property issues, particularly in the area of copyright and related rights. Special forms of protection have recently been adopted at the national level, providing an additional layer of protection for the rights of sports organizers.
