论检察权运行的双重控制

摘　　要：检察一体与检察独立作为现代检察权运行的“双重控制”机制,一方面检察系统内部组织领导遵循一体化方式,上命下从;另一方面,检察院对外行使检察权时,遵循独立原则。但是二者在运行过程中存在矛盾与冲突,如果弱化检察长的案件指令权,强化其案件收取和转移权,办案责任制就会在此起到非常重要的监督作用,并能缓和检察权运行机制中的紧张关系,进而寻找出应然价值选择。Procuratorial integration and procuratorial independence as the “dual control” mechanism for the operation of modern procuratorial power,on the one hand,the internal organization of the procuratorial system follow the integrated approach,and they follow the orders;on the other hand,when the procuratorate exercises the procuratorial power,they follow the principle of independence.However,there are contradictions and conflicts in the operation of the two.If the prosecution’ s case command power is weakened and the case collection and transfer rights are strengthened,the responsibility system will play a very important supervisory role here to ease the tension in the operation of the procuratorial power,and then find out the choice of value.
