多数决下村民集体决议内容违法的克服——以“外嫁女”土地权益保护为中心

摘　　要：村民集体决议是农村村民自治实践的典型形式,决议的形成以多数决为原则。然而,即使严格依法定程序开展集体决议,涉及“外嫁女”土地权益分配的决议结果却存在于法不符的问题,侵害着“外嫁女”的合法权益,暴露出多数决的民主议定程序难以对抗内容合法性审查的弊病。这一问题主观上是农民惜土如金的土地观念和多数决固有缺陷的糅合反应;客观上是村民集体决议内部合法性审查缺失和外部司法审查设计缺陷的联合结果。引入村民集体决议内部合法性审查,推行“外嫁女”土地权益问题的行政前置处理,可有效化解涉及“外嫁女”土地权益分配的纠纷。The collective resolution of villagers is a typical form of the practice of rural villager autonomy,and the formation of the resolution is based on majority decision.However,even if collective resolutions are strictly established in accordance with the law,the result of the resolution on the distribution of land rights and interests of“out-married women”often violates the legitimate rights and interests of“out-married women”,which is inconsistent with the law and exposes the malady that it is difficult to guarantee the legality in contents by majority decision.Subjectively,it is the combination of farmers’land idea and the inherent defects of majority decision.Objectively,it is the result of the lack of internal legality review of the collective resolution of villagers and the defects of external judicial review.It is an effective way to solve the problem by introducing the internal self-legitimacy review of the collective resolution of villagers and carrying out the administrative pre-treatment of conflict on land rights and interests of“out-married women”.
