PPP项目中初始信任对合同条款控制影响的情境模拟实验研究

摘　　要：PPP项目实施过程中的诸多问题均可归咎于合同中的控制条款不力,解决的有效途径即根据初始信任量身定制合同条款控制。首先,通过理论分析构建了PPP项目中初始信任影响合同条款控制的概念模型;然后,模拟了公共部门对私人部门初始信任的四种情境类型,开发了公共部门对私人部门合同条款控制的测量量表,并采集到88份有效的实验数据;最后,采用方差分析处理实验数据,对提出的概念模型进行实证检验。研究结果表明:⑴能力信任与产出控制中私人部门承担的投资控制责任呈正相关关系,除此之外,初始信任与产出控制、行为控制均呈负相关关系;⑵能力信任对偏差控制的负向影响较微弱,而善意信任对偏差控制的影响不显著;⑶其他产出控制对能力信任更为敏感,行为控制对善意信任更为敏感。在此基础上,结合代表性案例给出了政府部门依据其对社会资本的初始信任合理拟定合同中控制条款的建议。At present, there are 4 ways to form PPP contracts in China:(1) the public sector issues a short contract just like an administrative document,(2) the two parties research a contract through a long and difficult negotiation,(3) the two parties fill in the blanks on the basis of the model contract issued by the government, and (4) the public sector makes the unchangeable contract terms as a part of the purchase file. However, a lot of problems emerged during the process of these PPP projects, and most of them are caused by the ineffectiveness of its contract terms to control the private sector, including deficiency, invalidation and unrealistically strict terms. The effective way to solve it is that the public sector should design the contract term control according to its own initial trust in the private sector exactly. First, regarding the contract term control as a simple concept with only one dimension is pointed out to be the reason that the conclusions are diametrically opposite in different kinds of literature about the relationship between initial trust and contract term control. Accordingly, through a thorough literature review, the conceptual framework of initial trust, including competence trust and goodwill trust, is selected due to its obvious discrimination. The conceptual framework of contract term control, including output control, behavior control, and deviation control, is selected due to its applicability to PPP relationship. On this basis, a conceptual model about initial trust and contract term control in PPP project is proposed. Second, four different types of scenario simulation about the initial trust of the public sector to the private sector are designed, including high competence trust and high goodwill trust (CG), high competence trust and low goodwill trust (Cg), low competence trust and high goodwill trust (cG), low competence trust and low goodwill trust (cg).
