《艾滋病防治条例》修订应把握的若干原则性问题

摘　　要：从纵向看,中国艾滋病发生率以超过国家GDP增长率两倍的速度,保持每年15%以上的增长率快速增长,经性传播是主要途径。《艾滋病防治条例》修订应当重点解决并把握以下原则性问题:艾滋病防治既是医学问题,也是社会问题,但最主要的是社会问题;修订要标本兼治,但更主要的是治本,必须以解决社会问题为主,而不仅仅关注卫生问题;虽然中国艾滋病患者是少数,但其中绝大多数是吸毒、卖淫嫖娼的违法分子,修订应当以此为出发点考虑其合法权益;修订的主要目的应该是保护多数人,而不是仅仅保护艾滋病感染者,更不应该成为艾滋病人保护条例;应当发挥道德的作用;应当发挥社会主义制度的优越性和特殊性,创立能让国际组织采纳的中国艾滋病防治标准和做法,力争在全世界创造一种利用制度优势消灭艾滋病的最佳防控模式。In historical view,the incidence of AIDS in China is growing at a rate twice as fast as the country′s GDP growth rate,maintaining a rapid growth rate of more than 15% per year,and mainly sexually transmitted.The revision of the Regulation on AIDS Prevention and Control(briefed as the Regulation)should focus on solving these problems.AIDS prevention and treatment is not only a medical problem,but also a social issue,and mainly the social issue.The revision of the " Regulation" must address both the symptoms and root causes,but the most important is to solve the root cause.It must focus on solving social issues rather than only focusing on health problems.Although Chinese AIDS patients are a minority,the vast majority of them are illegal drug addicts and prostitutes.The revision should take this as a starting point to consider their legitimate rights and interests.The main purpose of the revision of the Regulation should be to protect the majority,not just people living with AIDS,let alone the AIDS-infected patient.The revision of the Regulation should play a moral role and exert the positive effect of "drowning people with spit stars".The revision of the Regulation should give play to the superiority and particularity of the socialist system.We should not always follow international norms formulated mainly by capitalist countries.we should have the confidence and courage to allow international organizations to adopt China′s AIDS prevention and control standards and practices,and strive to create a global system and the best model of AIDS prevention and control by utilizing the advantages of socialist system to eradicate AIDS in China.
