摘 要:《刑法修正案(九)》新增的“从业禁止”条款的定性问题一直以来引起学界广泛的争议,然而在适用对象、适用期限、限制内容等方面从业禁止条款都可以与资格刑的属性要求相适应。其次,在合目的性上,从业禁止条款也具有资格刑的目的要求。再次,从法条在整个刑法体系中所处的位置来看,对于否定从业禁止作为资格刑的法条依据并不成立。最后,在人格刑法学兴起的大背景下也可以说明从业禁止定性为资格刑的趋势。将从业禁止制度纳入到资格刑中对于我国现有的资格刑的体系来说起到了很好的补充作用。The qualitative problem of the newly added“employment prohibition”clause in the Ninth Amendment to the Criminal Law has always aroused widespread controversy in the academic circles. However,the employment prohibition clause in the object of application,the period of application,the content of restriction and other aspects can be compatible with the property requirements of qualification punishment. Secondly,in terms of purpose,the prohibition clause also has the purpose of qualification penalty. Thirdly,judging from the position of the law in the whole criminal law system,the legal basis for denying employment prohibition as qualification punishment is not tenable. Finally,the background of the rise of personality criminal jurisprudence can also explain the trend of qualified punishment. Incorporating the system of prohibition of employment into the system of qualifications punishment has played a very good supplementary role to the existing system of qualifications punishment in our country.
