论我国体育行业协会社会服务纪律处罚的适用

摘　　要：中国足球协会以亚洲足球联合会行业内处罚最新法规为渊源,在纪律处罚规则中将社会服务作为行业内部处罚种类之一,将会对体育行业内部处罚理念变革带来深远影响。然而,如何适用社会服务处罚,中国足球协会的纪律处罚规则中无明确的适用规定,实践中也还没有相关处罚案例的报道。在体育研究领域,有关社会服务处罚这一新型纪律处罚方式也还没有进入研究者的视野,对我国体育行业协会社会服务处罚适用的研究具有较为明显的意义。以社会服务令的内涵与起源、社会服务令的非刑事处罚价值、社会服务令改造经验为基础,论述我国体育行业协会社会服务处罚的本质特征与适用中的限制及需注意的几个问题后认为:社会服务纪律处罚的创设是我国体育行业协会内部治理的创新是自治权的体现,在适用中可考虑受罚人做一定时间体育行业内部公益活动以替代目前我国体育行业协会中部分处罚,需考虑到受罚人行为能力,对于违反兴奋剂法规等行为不应适用;应对受罚人完成体育社会公益活动能力进行考量,对受罚人做好监督以保证社会服务处罚得到切实执行。社会服务处罚具体适用更需要体育行业协会明确在发展竞技体育追求市场经济效益时,也不要忽视在行业内充分发展公益事业实现社会效益的最大化。The Chinese Football Association takes the latest regulations of the AFC industry as the source of punishment,and regards social services as one of the internal penalties of the industry,which will have a profound impact on the internal punishment concept of the sports industry in China.Based on the conno tation of the social service order,the origin and the experience of the transformation of social service orders and so on,we discussed the nature and limitations of the social service punishment of China's sports industry associations and several issues that need attention,and believed that the creation of social service disci plinary punishment is the innovation of internal governance of China's sports industry associations is the embodiment of autonomy;In the application,the penal ized person may be considered to do the internal public welfare activities of the sports industry for a certain period of time to replace the punishments in the cur rent sports industry associations in China, and the behavior of the penalty person must be considered.The ability to act against illegal stimulant regulations should not be applied;And the ability of the penalty person to complete the sports social welfare activities should be considered.The prisoner should be super vised.To ensure that social service penalties are effectively implemented.The specific application of social service punishment also requires the sports industry association to clearly develop the competitive economy in pursuit of market economic benefits,while fully developing the public welfare undertakings in the in dustry to maximize social benefits.
