新媒体治理视域下的表达权规制研究

摘　　要：社交媒体打破了传统媒体对信息传播和意见表达的垄断,人人都成为信息的传播者和接受者。表达主体的多元化和表达环境的复杂化,使传统媒体环境下形成的言论表达规范难以完全适用于以社交媒体为主的新媒体领域,表达权规制成为新媒体治理中重要而复杂的问题,社交媒体平台被赋予网络信息内容把关和判断的"权力"。在新媒体治理过程中,我国需要改变社交媒体平台对网络内容判断和处理的简单专断的状况,需要引入第三方事实核查机制,理性界定社交媒体平台权力与政府权力的边界,进而构建符合法治精神、尊重公民表达权利的网络管理体制和内容判断机制。Social media has broken the monopoly of traditional media in terms of information dissemination and opinion expressing,as everyone becomes the information communicator and receiver.Diversified expressing subjects as well as complicated expressing environment have made content regulating standards which were formed under the environment of traditional media no longer effective in the field of new media which was ruled by social media.Thus regulation of expressionright becomes an important and complicated problem in new media governance.Social media platform is empowered to check and judge the network information.In the process of new media governance,China needs to change the way social media platform judges and deals with network information arbitrarily,introduce the third-party fact checking mechanism,and put forward that the power boundary between social media and government should be defined rationally,in order to build amechanism of network management and content judgment which accords with the spirit of rule of law and respects citizens' expression right.
