应急性警察权行使的原则与优化路径

摘　　要：在高风险社会,公安机关是风险防范和应对处置的主力军。为有效防范和应对交叉叠加的风险,应构建科学合理的应急性警察权力运行机制。网络新媒体技术和大数据技术的发展使得风险加剧,公安机关应急性警察权的运行机制与严峻复杂的治安形势还不相适应,与警察权的行使原则不符。应急性警察权的行使,应当遵循程序与效率相统一原则、比例原则、信息公开原则。同时,为提高应对突发事件的效率,必须创新应急性警察权运行机制,要科学配置应急权力,要规范应急权力行使标准,要建立容错机制,要创新信息的开发、利用和公开方式,要创新应急性警察权的监督体系等。In high-risk society, public security organs are the main force of risk prevention and response. In order to prevent and respond to the overlapping risks effectively, we should build a scientific and reasonable emergency police power operation mechanism. With the development of new media technology and big data technology, the risk is aggravated. The operation mechanism of emergency police power in public security organs is not compatible with the severe and complicated public security situation, and is not in conformity with the principle of the exercise of police power. The exercise of emergency police power should follow the principle of unification of procedure and efficiency, the principle of proportionality and the principle of information disclosure. At the same time, in order to improve the efficiency of dealing with emergencies,we must innovate the operation mechanism of emergency police power, allocate emergency power scientifically, standardize the exercising emergency power, establish fault-tolerant mechanism, innovate the way of developing, utilizing and publishing information, and innovate the supervision system of emergency police power.
