对“国家海洋基本法”起草工作的几点思考

摘　　要：制定海洋基本法,旨在对我国海洋法律体系进行顶层设计,把我国的基本海域制度、海洋管理体制、海洋资源开发利用、海上执法、海洋国际事务等最基础的体制制度确定下来。在海洋基本法制定中,应加强权责制度设计,并且要放眼全球海洋,把我国关于全球海洋治理和推进海洋命运共同体的理念体现在新法中。The legislation of China's Ocean Basic Law is about to design the system of China's ocean law from the top-level. It functions as an overall framework,proposing legal principles for all kinds of ocean affairs and activities,including ocean space,ocean governance,ocean resources development,ocean law enforcement and international ocean affairs. In the drafting of Ocean Basic Law,it s essential to strengthen the design of rights and responsibilities institution,and expand the vision from peripheral sea to global sea,involving the idea of community with a shared marine future into the legislation.
