摘 要:公共体育场馆法人治理是深化体育治理的核心内容,也是国家体育治理的空间逻辑。采用专家访谈法、实地调研法等研究方法就公共体育场馆法人治理类型、评价与路径进行了深入探讨,得出以下研究结果:公共体育场馆体制机制改革最根本的是治理改革,公共体育场馆的治理实质上是关于政府、主管部门、公共体育场馆管理者的职责、权利和义务的制度化安排,两权分离与委托代理是公共体育场馆法人治理研究问题的源起;我国公共体育场馆法人治理的实践,分为决策权上位型、决策权中位型、决策权下位型三种治理模式,三种模式在治理结构和机制方面有明显区别;从国家、社会与市场视角建立法人治理模式评价的九个维度,对我国三种治理模式进行评价;探讨中国公立体育场馆法人治理模式的选择及决策中位型模式下公共体育场馆内部治理结构构建路径,重点从法人治理结构构建、内部治理机制构建、外部治理机制构建三方面展开研究。Corporate governance in public stadiums in China is the core content of deepening the separation of the two rights of venues.Adopting literature study,expert interviews,field research methods and other methods to conduct in-depth discussion on the types,evaluations and paths of corporate governance in public sports venues,the following findings are obtained:(1)The most fundamental reform of the institutional mechanism of public sports venues is governance.The governance of public sports venues is essentially an institutionalized arrangement of the duties,rights and obligations of the government,the relative departments,and the public sports stadium managers.The separation of the two powers and the agency is the source of the research on the corporate governance of public sports venues.(2)According to the investigation,the practice of corporate governance in public sports venues in China is divided into three types:governance-oriented power,decision-power medium type,and decision-making power.The three models have obvious differences in rational structure and mechanism.(3)A nine dimensions of corporate governance model evaluation from the perspective of state,society and market,and evaluating three governance models in China was built.(4)The choice of corporate governance model for public stadiums in China and the decision-making path for the internal governance structure of the neutral public stadiums was established,focusing on the construction of corporate governance structure,the construction of internal governance mechanisms,and the construction of external governance mechanisms.
