摘　　要：在全球加强宏观审慎监管的背景下,对互联网金融的监管不容懈怠。对此,互联网金融监管行政法律制度的完善将发挥重要作用。从作为行政法调整对象及行政相对人等的制度“需求侧”而言,互联网金融存在着“互联网”+“金融”的风险;从作为行政主体等的制度“供给侧”而言,政府作为“理性经济人”的“自私举动”及无法避免的“管制俘获”也一再加剧了互联网金融发展中潜在的各类风险。在因应之道上,要着重革新行政法理念、重构监管主体、完善准入立法、强化处罚立法、健全救济体系。Internet finance has made remarkable achievements.However,there are still many problems and deficiencies in the area of Internet finance.Especially in the context of the profound changes in the global financial system and the general trend of strengthening macro-prudential supervision,the supervision over the Internet finance cannot be tolerated slack.The construction and improvement of the administrative and legal system for the supervision over the Internet finance will play an important role.We also urgently need to constantly improve the legal system of Internet finance regulations.From the"demand side"of the object of the administrative regulations and the administrative counterparties,the Internet finance itself has the risk of traditional finance as well as the risk of"Internet"and"finance".In addition,there are also risks in connection with each industry involved in the Internet finance.From the"supply side"of the administrative body,the"selfish move"of the government as a"rational economic man"and unavoidable"capture of control"have repeatedly aggravated the potential risk of Internet finance.In response,we should emphasize innovation concept of administrative law,refactor regulatory agencies,access to legislation,strengthen the punishment legislation,improve the relief system.Through the above measures,we can set up a sound system of the Internet financial regulation of administrative law.
