摘　　要：从一件在造纸领域一起专利诉讼案件出发,结合专利复审委员会针对涉案专利做出的三次无效宣告请求审查决定书、北京市第一中级人民法院做出的一审行政判决书、以及北京市高级人民法院做出的二审行政判决书,综合分析各方在涉案专利创造性判断过程中的争议焦点,以期为专利授权、确权时的创造性判断提供借鉴和参考。Based on a profound patent litigation which lasted six years in paper making field, how to assess the inventive step of patent was discussed. According to the three examination decisions on request for invalidation by Patent Reexamination Board of Cnipa, and written administrative judgment of first instance by Beijing No.1 Intermediate People’s Court, and written administrative judgment of second instance by Beijing High People’s Court, the paper discussed the bones of contention while assessing inventive step, so as to provide reference and inspiration while assessing the inventive step of patent.
