摘　　要：期货交易数据权利属性纠纷反映出的问题是期货交易数据权利属性不明确。更深一层的问题是我国现有的法律制度无法对期货交易数据提供有效的保护。鉴于期货交易数据实质上可以分为纯粹的体力劳动创作、满足一定程度原创性的智力劳动创作和满足一定程度独创性的智力劳动创作三类,所以,可以对期货交易数据实行分级保护。具体而言,可以以劳动产权理论为理论基础对委买委卖价等期货交易数据进行保护,以普通法系国家中的版权理论为理论基础对合约名称等期货交易数据和结算价等期货交易数据进行保护,以大陆法系国家中的著作权理论为理论基础对市场行情、价格分析等期货交易数据进行保护。Disputes for the right attributes of the futures transaction data reflect the right attributes of the futures transaction data are uncertain or unclear. The deeper problem is Chinese statute laws which are in force can’ t protect the futures transaction data properly and effectively. Because of the futures transaction data can be classified as the pure labor work,the original intellectual work and the creative intellectual work.Therefore,we can protect the futures transaction data hierarchically. Which means,we can protect the futures transaction data such as the bid/ask prices and so on using the theory of the property rights of labor;protect the futures transaction data such as the contract names,the Settlement prices and so on using the copyright theory in the common law system;protect the futures transaction data such as the derived data,third-party data and so on using the copyright theory in the civil law system.
