摘　　要：贫困阻碍充分享受人权,克服贫困是充分享有人权的必要手段。在精准扶贫战略实施过程中,将免于贫困作为贫困者的一项人权进行审视,可以补缺以往对待贫困问题的局限和疏漏,无论是对于精准扶贫战略的有效实施还是对于贫困者自身权利的实现,都具有非常重要的意义。免于贫困的权利符合人权的基本构成要素,因而是一项独立的基本人权,不能被其他权利所替代或覆盖。社会正义论与社会契约论为免于贫困的权利提供了深厚的法哲学基础。免于贫困的权利具有内在诉求的正当性,因而具有法律权利的属性。只有通过完备的法律机制的保障,免于贫困的权利才能最终得以实现。Poverty hinders the full enjoyment of human rights and overcoming poverty is a necessary means to the full enjoyment of human rights. In the process of implementing the targeted poverty alleviation strategy,it is of great significance to examine the freedom from poverty as a human right of the poor,so as to make up for the limitations and omissions in the previous treatment of poverty,both for the effective implementation of the targeted poverty alleviation strategy and for the realization of the rights of the poor. The right to freedom from poverty is consistent with the basic elements of human rights and, as such, is an independent fundamental human right that cannot be replaced or covered by other rights. The theory of social justice and the theory of social contract provide a deep philosophical foundation for the right to freedom from poverty. The right to freedom from poverty has the inherent legitimacy of appeal and thus has the attribute of legal rights. The right to freedom from poverty can be realized only through the guarantee of a complete legal mechanism.
