摘  要:立法解释是立法机关立法意志的延伸。成文法不合目的性、不周延性、模糊性和滞后性使得立法解释成为必要。立法解释原则上应依据立法原意解释,也可以为适应形势,在文义范围内进行扩张或限缩解释。立法解释应当严格遵循法定程序。为解决目前立法解释虚置化问题,立法机关应当设置专门机关负责司法解释一般工作。应当严格区分立法解释与司法解释,让司法解释回归本职,让立法解释发挥应有功能。Legislative interpretation is the extension of the legislative will of the legislature. Legislative interpretation is necessary because the codified law may have the defects of being unsuited?to the purpose, incompleteness, fuzziness and hysteresis. In principle, Legislative interpretation should be interpreted according to the original intention of legislation. In order to adapt to the situation, it can also be interpreted in expansion or in restriction within the scope of meaning. Legislative interpretation should strictly follow legal procedures. In order to solve the problem of the vacancy of legislative interpretation, the legislature should set up special organs to take charge of the general work of judicial interpretation. We should make a strict distinction between legislative interpretation and judicial interpretation so that judicial interpretation can return to its original function and legislative interpretation can play its due role.
