党政问责制复出机制的规范化问题新探

摘　　要：我国党政问责制复出机制中尚存程序性失范和实质性失范问题,必须从完善党内法规和国家法律两方面着手加以解决。一方面,要加快完善有关问责的党内法规体系,调高责后复出的最低时限门槛,依据不同责任及其责后表现确定有差别的限制复出条件,并重视建立更为透明的复出决定公示制度。另一方面,要建立健全有关党政问责制的法律体系,完善《公务员法》对复出条件的限制规定,补充完善《监察法》有关问责复出的内容,积极推进《监察官法》的立法工作。Two types of anomies, i.e. procedural anomies and substantive anomies exist in the mechanism of official ' s resuming post in the Party and government accountability system in China. The present paper analyzes the underlying reasons for the anomies in the accountability system, and argues that the mechanism standardization can be perfected from two aspects, i.e. Party regulations and State laws. On the one hand, the paper proposed three solutions in the Party regulation, i.e. prolonging the minimum periods of resuming post, formulation of the regulations for officials' resuming posts in terms of their performances and establishment of a transparent system of publicity;on the other hand, four aspects should be promoted in the state laws, i. e. consummation of law systems for accountability, perfection of policies for resuming post in the Civil Service Law, adding more specific regulations in the Supervision Law and promote the enact of Law of Procurators.
