国际传统知识保护模式分析与中医药对策建议

摘　　要：本文根据《中医药法》中对于中医药传统知识保护工作的要求,就目前国际传统知识保护的主要模式:防御性保护和积极性保护,分别以印度和秘鲁两国为例进行了分析,理清了两种模式的依托制度、技术工作、主要目的和用途等特征。在此基础上,结合中医药传统知识保护工作的需求特点,提出中医药传统知识保护可以综合利用这两种保护模式,以"防御性与积极性保护同步推进,名录与制度并行建设"的思路开展保护工作。名录建设中应兼顾古医籍项目和活态性项目的登记,制度构建要兼顾防御性和积极性保护需求。建立起保护工作的长效机制,形成完整的中医药传统知识保护体系。According to the requirements of the protection of traditional Chinese medicine in the Chinese Medicine Law,the current model of protection of traditional knowledge: Defensive Protection and Positive Protection were analyzed and India and Peru were used as examples. This research clarified the features of the two modes of system, technical work,main purpose and use. Based on this, combining the needs of the protection of traditional Chinese medicine knowledge, it is proposed that the traditional knowledge protection of Chinese medicine can make use of these two protection modes comprehensively, and precede protection work with the idea of"promoting Defensive Protection and Positive Protection simultaneously and simultaneously building lists and systems". In the construction of the lists, we must take into account the registration of ancient medical items and live items. The construction of the system must take into account both defensive and positive protection needs, and establish a long-term mechanism for protection work and form a complete protection system for traditional knowledge of traditional Chinese medicine.
