摘 要:结构主义视角下的法人类学研究,多通过规则适用过程来剖析习惯法效用的发挥,社会层级分类由此成为习惯法适用中的文化切入前提。既有研究显示,对于习惯法的阐释多基于对象群体对传统规则的一致性理解与遵从。与此设定所不同,通过对中缅边境佤族YH村纠纷调解的个案分析发现,现代化带来的价值认知分化推动了个体化发展趋向,并在利益诉求和价值判断两个层面凸显出族群习惯法从“面”到“点”的适用逻辑变迁,进而为重塑规范有效性提供了新视域。From the perspective of structuralism, legal anthropology studies mainly analyze the effectiveness of customary law through the application of rules, taking social stratification as an cultural entry point. The current domestic research on mediation of ethnic minority disputes shows that, the interpretation of customary law is mainly based on the applicable objects′ consistent understanding of and compliance with traditional rules. From the case study of the mediation process of the Wa People in YH village at China-Myanmar border, it can be found that, unlike the existing interpretive framework, the differentiation of value cognition brought by modernization promotes the developmental trend of individualization, and the change of application logic of ethnic customary law from “plane” to “point” is highlighted in the two levels of interest appeal and value judgment, thus providing a new perspective for remoulding the validity of norms.
