论精神病患者劫持人质案件的处置方略

摘　　要：精神病患者劫持人质案件是当前刑事司法领域中的理论短板和实践难题之一,亟须深化该类案件的理论认识,提高该类案件的处置能力。对该类案件的归纳整理以及通过中美刑事司法部门的对比分析和剖析该类案件的处置困境,在坚持综合性双向研究路径的基础上,以精神分裂症患者劫持人质为对象,阐释精神分裂症及其与劫持人质高度关联的主要临床症状,并对实施劫持人质的精神分裂症患者进行现场鉴别,把握精神分裂症患者实施劫持人质案件的主要特点,明确处置实施劫持人质案件的精神分裂症患者的要领。只有这样才能有助于刑事司法机关系统掌握精神病患者劫持人质案件的特点,破解处置实践中的诸多难题。Cases involving hostage-taking by psychotic patients are one of the theoretical shortcomings and practical difficulties in the current criminal justice field.It is urgent to deepen the theoretical understanding of such cases and improve the handling capacity of such cases.Through summarizing and sorting out such cases and comparing and analyzing the criminal justice departments of China and the United States,the disposal dilemma of such cases is analyzed.On the basis of adhering to the comprehensive two-way research path,the major clinical symptoms of schizophrenia and its high correlation with hostage-taking are explained.Suggestions for on-site identification of schizophrenic patients who take hostages are put forward.The main characteristics of hostage-taking cases carried out by schizophrenic patients are grasped,and the essentials for handling schizophrenic patients who take hostages are clarified.This is helpful for criminal judicial organs to systematically grasp the characteristics of cases involving hostage-taking by psychotic patients and solve many difficult problems in handling practices.
