摘 要:恐怖主义行为因情节不一可区分为恐怖主义行政违法行为与恐怖主义刑事犯罪行为,我国对其认定采取的是行政认定与司法认定“双轨制”的模式。虽然行政违法与刑事犯罪在社会危害性程度上有本质的区别,但是二者也存在密切的内在联系,在恐怖主义认定的实践和理论中都具有行刑衔接的必要性。由于存在立法价值选择上重安全轻自由、反恐立法体系组织上重形式轻实质的倾向,导致出现反恐对象指向不明、立法体例合理性欠缺、执法司法程序衔接不力的问题,影响了反恐工作的公正与效率。对此,应从理念导引、形式与实质并重的法律保障方面建构恐怖主义行为认定的行刑衔接机制。Acts of terrorsim can be divided into terrorism administrative violate acts and terrorism criminal acts because of different circumstances. In terms of identification, China has identified and dealt with the "dual track system" model of administrative recognition and criminal judicial recognition. Although administrative violations and criminal offenses have essential differences in the degree of social harm, the two are closely related internally, and it is determined that there is an inevitability of execution in practice. Because of the tendency to choose safety value and light liberty value in the filed of legislative value, the tendency to focus on the form and the light substance in the filed of anti-terrorism legislative system ,lead to a phenomenon witch the anti-terrorism object is unclear, the legitimacy of the legislative system is lacking, and the law enforcement judicial procedures are not well connected, which affects the fairness and the efficiency of the anti-terrorism work. In this regard, it is necessary to construct a system of conceptual guiding and both pay attention to form and substance of laws, constructing the cohesive mechanism of administrative and criminal justice recognition of terrorism acts.
