摘 要:为加速森林资源的优化配置,将土地承包经营权分为承包权和经营权,经营权单独参与林地流转是完善集体林权制度改革的方向。从20世纪90年代开始,国内外社会资本投融资山林经营至今的20多年正是我国市场经济快速发展、集体林权制度改革不断深化的转型期,林地租赁经营普遍受到林地流转合同纠纷的长期困扰。文章以广西壮族自治区人工林经营企业为调研对象,分析人工林经营权合同纠纷的制度成因,从制度设计与实施机制方面提出针对性的对策建议,为集体林三权分置的制度完善提供研究依据。To accelerate the optimal allocation of forest resources, the land contractual management right is divided into contractual right and management right, and the separation and re-circulation is the direction of improving the reform of collective forest tenure system. Since the 1990 s, the domestic and foreign social capital has entered the forest for more than 20 years, which was the period of rapid development of market economy and the transition period of the reform of collective forest tenure system in China. Plantation management was generally plagued by contract disputes in the period. Studying Guangxi plantation enterprises, this paper analyzed the institutional causes of contract disputes over plantation management rights and suggested targeted countermeasures and suggestions from system design and implementation mechanism, to provide research basis for the improvement of the system of the separation of three powers of collective forestry.
