摘　　要：司法保障是“一带一路”建设法治化不可或缺的重要力量。外商投资者的诉讼权利越大,对侵害投资者权益的威慑就越大,外商投资者就会更加倾向于选择诉讼行为以维护自己的合法权益。同时,法院对外商投资者的保护力度与法院行使审判权的独立程度密切相关,外商投资者的胜诉概率与司法审判独立性的程度成正比,而外商投资者的上诉概率则与司法审判独立性的程度成反比。充分发挥司法能动性和继续强化司法审判独立性有利于实现外商投资市场保护的私法自治和契约自由。Judicial guarantee is an indispensable and important force in the construction of "One Belt And One Road". The greater the litigation right of foreign investors in China, the greater the deterrent to the infringement of investors’ rights and interests. Meanwhile, the court’s protection of foreign investors is closely related to the independence of the court in exercising its judicial power. The success probability of foreign investors is directly proportional to the independence of judicial trials, while the appeal probability of foreign investors is inversely proportional to the independence of judicial trial. Giving full play to judicial initiative and continuing to strengthen judicial independence are conducive to realizing the autonomy of private law and freedom of contract in the protection of foreign investment market.
