摘 要:在现有政策法规文本中,对生态保护补偿的界定有"利用者补偿""生态损害赔偿""奖惩双向补偿"等多种表述,概念的模糊直接影响到生态保护补偿制度构建与运行效果。生态保护补偿制度的适用范围应仅限于正外部性补偿,在法律性质上与自然资源有偿使用、生态损害赔偿、环境保护税费等制度存在本质差异。未来我国生态保护补偿制度的完善需要在立法时清晰界定其含义,厘清"谁补偿谁""补偿多少""怎么补偿"等问题,并依据环境法一体化治理原则,推进生态保护补偿制度与相关制度的协调对接。In the text of existing policies and regulations, there are such expressions as "user compensation","ecological damage compensation","reward and punishment two-way compensation", and they directly affect construction and operation effect of ecological protection compensation system. The scope of application of the ecological protection compensation system should be limited to positive external compensation, and there are essential differences in the legal nature of the use of natural resources, compensation for ecological damage, environmental protection taxes and fees. In the future, the construction of China’s ecological protection compensation system needs to clearly define its meaning in legislation, clarify the issues of "whoever compensates","how much compensation" and "how to compensate", and promotes ecology according to the principle of integrated environmental law. The coordination of protection compensation system and related systems will provide legal guarantee for the ecological protection compensation practices activities through system reshaping.
