摘  要:长篇世情小说《歧路灯》叙述了主人公谭绍闻在父亲去世以后被人引诱,结交匪人并沉溺赌博,乃至多次涉讼,最终迷途知返重归正途的故事。小说在描写案件审理过程时,往往忽略了法律条文,而侧重考虑儒家的一些纲常伦理或涉案人的身份等,从而使案件的审理结果“合情合理”。究其原因,一方面和儒家观念对法律条文和官员思想的影响密不可分,同时和作者的生平经历相关。挖掘出这一点,对我们认识儒家观念在清代社会生活,尤其是诉讼中的地位和影响有一定参考意义。The novel Lamp on the Forked Road tells a story of how Tan Shaowen, the hero, was tempted after his father′s death to associate with bandits, indulged in gambling and even involved in litigation repeatedly before he eventually realized his errors and started a new life. In describing the hearing of cases, the novel often neglects the legal provisions, and focuses on the Confucian ethics or the identity of the person involved so as to justify the trial result. For one thing, this is inextricably linked with the impact of Confucianism on legal provisions and the officials′ ways of thinking;for another, it is related to the author′s own life experiences. The analysis has some reference significance to the understanding of the status of Confucianism in the Qing society, especially its impact on litigation.
