摘 要:由于建设项目的复杂性、动态性和长期性,工程纠纷不可避免。相比诉讼程序,替代性纠纷解决方法(ADR)更为快速友好。但在实际纠纷发生前,ADR的实施成本很难预估,而且在面对复杂的纠纷时,即使采用ADR也不能消除重大项目资金损失的可能性。虽然学术界对各种ADR技术已经进行了大量研究,但很少有研究关注实施ADR给成本控制带来的负面影响。本文首先从工程纠纷及其解决方法入手,阐述了实施ADR带来的成本风险,最后从风险控制和转移角度提出风险应对策略。Due to the complexity, dynamic and long-term nature of construction projects, construction disputes are inevitable. Compared with the litigation, alternative dispute resolution is more effective and friendly. However, the ADR cost is difficult to predict before the actual occurrence of the dispute, and also in some complex disputes, even the adoption of ADR may require very high project expenditures. Although there has been a lot of researches focusing on various ADR techniques, few studies have paid attention to the cost risks arisen by implementing ADR. This paper begins with the introduction of construction disputes and disputes solutions, expounds the cost risk of implementing ADR, and finally proposes the response strategy based on risk control and transfer.
