比较视野下我国基本农田最严格保护制度研究

摘　　要：从制度的历史演进和内容特点两个方面,对我国基本农田最严格保护制度与水资源和大气的最严格保护制度进行了比较,发现由于主体特性和保护目的不同等原因,我国基本农田的最严格保护制度更多侧重于社会属性和数量限定,强调特殊保护,在质量提高和利益主体管理上较为缺乏,相关的制度规定还有待完善。结合水资源和大气最严格保护制度的已有经验,针对我国如何完善基本农田最严格保护制度提出了建立专门法律、形成完善的制度体系,加强对基本农田质量的保护、完善地力建设和环境保护制度,完善对利益主体的管理、形成基本农田补偿制度等建议,为我国基本农田的保护实践提供制度基础,以严格保证我国的粮食安全和社会稳定。This paper sorts out the historical evolution and content characteristics of the system and compares the strictest protection system of basic farmland in China with the most stringent protection system of water resources and the atmosphere,and finds that the basic farmland is due to the different characteristics of the main body and the purpose of protection.Strict protection system focuses more on social attributes and quantity limits,emphasizes“special protection”,lacks quality improvement and management of interest subjects,and relevant institutional regulations still need to be improved.Finally,Based on the experience of the strictest protection system of water resources and atmosphere,the paper puts forward some suggestions for the perfection of the most stringent protection system of basic farmland,such as the establishment of speciaized laws,improvement of a perfect system,strengthening the protection of basic farmland quality,the improvement of the construction of land resources and the environmental protection system, the improvement of the management of stakeholders,and the formation of the compensation system of basic farmland.It is hoped that the strictest protection system of basic farmland will be established to provide the institutional basis for the protection practice of basic farmland,so as to strictly guarantee the food security and social stability in China.
