“一带一路”背景下民族自治地区立法变通权改革路径探析

摘  要:"一带一路"倡议的实施最终需要沿线国家的地方政府和企业的配合。而民族区域自治地方立法变通权是宪法以及相关法律中规定的民族自治地区能够在综合考虑地区政治、经济、文化特殊性的基础上对一些特定法律规定进行立法变通的权力。对于民族自治地区而言,立法变通权是宪法所赋予的一种特殊权力,该权力的赋予为民族区域实现自治提供了重要的手段支撑。当下民族自治地方法规的形式和实质分离、可操作性缺失、公民参与度不够、信息披露不充分、评估机制落后是立法变通权改革最紧迫的领域。参与"一带一路"建设的民族自治地方,在新时代必须自觉地改革已有的不合时宜的法规,提升投资、贸易的法治环境。The implementation of the Belt and Road Initiative needs the cooperation of local governments and enterprises in countries along the Belt and Road.The legislative accommodation power in ethnic autonomous areas is the right to adjust some specific laws and regulations to accommodate the special political,economic and cultural conditions in ethnic autonomous areas,which is stipulated in China’s constitution and relevant laws.For ethnic autonomous regions,it is a special power conferred by the constitution,which serves as an important means to support the realization of ethnic autonomy.At present,the legislative accommodation power in ethnic autonomous regions suffer from face problems such as the separation of its form and substance,lack of operability,low participation,insufficient information disclosure,and backward evaluation mechanism,all of which are in urgent need of reforming.In the new era,the ethnic autonomous areas participating in the Belt and Road Initiative should voluntarily reform their existing outdated laws and regulations so as to improve the legal environment for investment and trade.
