摘 要:在城乡规划行政管理事权划归到自然资源部,重新构建我国空间规划体系的背景下,北京市新修订了《北京市城乡规划条例》。由于该条例是职能改革即城乡规划行政管理事权部门变更后,在国家空间规划体系尚不明朗、原城乡规划法律体系尚未调整时期出台的首个城乡规划条例,既代表了职能改革后地方规划事权和管理的发展方向,也在一定程度上体现了国家部门对城乡规划管理改革的意志。《北京市城乡规划条例》对许可内容做了重大调整和改革,包括建立新空间规划编制、审批和管理体系,扩大规划管理部门事权范围,简化行政许可和竣工验收流程,规划综合实施方案替代控制性详细规划成为核发规划许可的依据,合理下沉违法建设管理的权限,建立城市体检评估机制等。文章分析了《北京市城乡规划条例》出台后面临的难点和问题,总结了未来地方相关条例修订的总体改革方向。As the urban planning administrative right is assigned to the Ministry of Natural Resources and national spatial planning system is restructured, Beijing has revised Beijing Urban and Rural Planning Regulations (hereinafter referred to as The Regulations). It is the first regulation of the same kind in the course of national spatial planning system reform, which not only represents the orientation of administrative rights and management, but also re flects the will of national authority. It makes major adjustments of planning approval that include: establishing a new spatial planning compilation, inspection and approval, and management system;expanding the scope of planning administrative rights;simplifying administrative approval and construction examination process;comprehensive plan instead of regulatory plan as the basis of planning approval;devolution of the administrative right of illegal construction management;establishing an evaluation mechanism of urban examination. The paper analyzes the problems and dif ficulties after The Regulations is enacted, and concludes the orientation of future revision on The Regulations.
