摘　　要：在窃取型贪污罪中,行为对象是他人占有的公共财物;“窃取”是指行为人以违背他人意志的方式将其具有职责义务的他人占有的公共财物非法占为己有。窃取型贪污罪所利用的“职务”是指对他人占有的公共财物具有职责义务的工作。窃取型“利用职务上的便利”是指利用对他人占有的公共财物具有职务关联性的优势地位。当行为人因从事的工作而获得对他人占有的公共财物具有职责义务,并利用对他人占有的公共财物具有职务关联性的优势地位窃取该公共财物时,应当对窃取型“利用职务上的便利”作出肯定性的评价。In the crime of stealing type corruption , the object of action is the public property possessed by others;"stealing" means that the actor illegally occupies the public property possessed by others with duties and obligations in a manner contrary to the will of others. The "duties" used in the crime of stealing type corruption refers to the work that has duties and obligations to the public property occupied by others. The stealing type of "utilizing the convenience of duties" refers to the dominant position of utilizing the public property possessed by others. When the actor obtains responsibility and obligation for the public property possessed by others because of his work, and steals the public property by taking advantage of dominant position of duties relevance, he should make a positive evaluation of the stealing type of "utilizing the convenience of his duties".
