发包方土地经营权流转合同终止权研究

摘　　要：新修订的《农村土地承包法》第64条创设了发包方对于土地经营权流转合同的终止权制度,这是针对"承包期内发包方不得收回承包地"之禁止性规定而作的一项补救性规定。发包方终止权不是发包方固有的一项合同解除权,应认定为法律赋予发包方的一项"代位解除权"。发包方终止权的行使须满足法定的实质要件和形式要件。在行使条件成就时,发包方应首先催告承包方在合理期限内解除流转合同;若承包方经催告后仍怠于解除流转合同,则发包方可以采取通知解除或者诉讼解除的方式行使代位解除权。流转合同解除后,土地经营权人应退出并交还承包地,承包地上的权利负担因流转合同之解除而消灭,原土地经营权人对于相关损害还须承担损害赔偿责任。若承包方在向其交还承包地后仍实施弃耕抛荒行为,则发包方可行使"强制代耕权",以保障"禁止闲置荒芜农地"之政策目标的实现。Article 64 of the newly revised Rural Land Contracting Law establishes the termination right system of the contract for the transfer of land management rights by the owner, which is a remedial provision for the prohibitive stipulation that the owner shall not recover the contracted land during the contracting period. The termination right of the owner is not an inherent right of contract termination of the owner, which should be recognized as a "right of subrogation termination" granted to the owner by law. The exercising of the termination right of the owner must satisfy the legal substantive requirements and formal requirements. When the conditions are fulfilled, the owner shall first urge the contractor to terminate the transfer contract within a reasonable period of time;if the contractor is still lazy to terminate the transfer contract after the notification, the owner may exercise the right of subrogation termination by means of notice termination or litigation termination. After the termination of the transfer contract, the land management holder shall withdraw and return the contracted land, and the right burden on the contracted land shall be eliminated due to the termination of the transfer contract, and the original land management holder shall also be liable for damages related to the damage. If the contractor still abandoned the contracted land after returning the contracted land to the owner, the owner may exercise the "compulsory right to substitute farmland" to ensure the realization of the policy goal of "prohibiting idle wasteland".
