摘　　要：随着新一轮人工智能技术革命到来,人工智能将广泛运用到我们的工作和休闲娱乐中,在承认智能机器人、无人驾驶汽车给我们带来便利的同时,其侵权的现象也不容忽视。如何妥善处理好人工智能侵权行为后的责任归属已成为法学理论界不可回避的问题。因此,本文依据人工智能技术自主性程度不同,区分强人工智能、弱人工智能,着重针对国内、国外现有的研究现状中对强人工智能先分类定位,再依据不同定位进行责任归属从而产生的局限与不足进行梳理、分析,提出解决这一问题的思路:先设立一部能与国际接轨的,覆盖各行各业强人工智能侵权事故责任归属的单行法,置于民事法律体系中,在真正地整合现有的抽象零散条款基础下,弥补不适应现实的障碍。再通过具体的实践运行后及时补充一些特殊的可操作性强的制度规范,从而保障我国在人工智能时代下掌握法律规范的发言权。With the advent of a new round of AI technology revolution, AI will be widely used in our work and leisure entertainment. While acknowledging that an intelligent robot and an unmanned car bring us convenience, its infringement cannot be ignored. How to properly handle the liability attribution after artificial intelligence infringement has become an unavoidable problem in the field of legal theory. Therefore, according to the different degree of autonomy of AI technology, this paper distinguishes between strong AI and weak AI, focusing on the classification and localization of strong AI in current research home and abroad, and then combing and analyzing the limitations and shortcomings caused by different localization, and putting forward solutions. Firstly, establishing a single law which can be in consistence with the international standards and cover the liability attribution of AI tort accidents in all walks of life. It will be placed in the civil legal system, on the basis of truly integrating the existing abstract and scattered clauses, and make up for the shortages that they do not adapt to the reality. Then through the specific practice, we can supplement some specific and feasible system and specifications in time, so as to ensure that our country has gained its place in the era of artificial intelligence.
