摘  要:研究网约专车营业权理论旨在为网约专车的营业权制度建构提供合法、合理的理论依据。当前网约专车营业面临了诸多困境,本文以营业权理论为基础,从贯彻营业自由价值、发挥市场自主配置资源作用以及理清网约专车的利益主体权责边界的角度出发,突破网约专车营业的实践困境。在此基础上提出了降低市场准入门槛、明确网约专车平台的安全责任、创新监管途径以及完善网约专车营业的配套法律法规等规制路径,在切实保护消费者权益的同时为网约专车创造一个良好的市场营业环境。The study of the network-specific car business rights theory aims to provide a legal and reasonable theoretical basis for the construction of the network-specific car business rights system. At present,the operation of private car business is facing many difficulties. Based on the theory of business rights,this paper breaks through the network car from the perspective of implementing the free value of business,giving play to the role of market independent allocation of resources, and clarifying the boundary of the rights and interests of the interests of the network. Practice dilemma of business. On this basis, it puts forward the regulatory path to reduce the market entry threshold, clarify the safety responsibility of the network-specific car platform, innovative supervision channels, and improve the supporting laws and regulations for the operation of the network-specific car, and protect the consumer rights while at the same time create a good market environment.
