摘 要:为了防范高校性骚扰,教育部于2014年颁布管理规定,将禁止教师对学生实施性骚扰纳入师德管理规范,对违反规定者进行严厉处罚。但是高校性骚扰现象并没有随着该规定的实施得到有效遏制,近几年来反而愈演愈烈。本研究根据文件颁布后的相关调查报告和资料,对我国高校性骚扰的特征进行概括,将高校性骚扰发生的原因归纳为内部防范制度缺失、外部制度存在漏洞、受害人自我保护意识相对薄弱,以及受我国性耻辱文化传统和不良社会环境的影响等四个方面,以期为我国相关制度的制定和完善提供一些思路。The Ministry of Education issued a management regulation in 2014 to prevent the occurrence of sexual harassment in universities. The regulation stipulates that sexual harassment inflicted by teachers to his or her students should be added to teachers’ ethics management and that any violators will be granted with severe punishment. However, sexual harassment in universities has become more severe instead of being contained over the past years. The thesis makes an analysis of the features of sexual assault in universities on the basis of relevant reports and publications after the promulgation of the regulation in 2014. It categorizes the causes of sexual harassment in universities into four aspects: the absence of internal prevention system, the loopholes in external systems, lower awareness of self-protection on the side of victims, and China’s special cultural traditions and social environment. The article hopes that its analysis can provide relevant departments with insights in the formulation and improvement of relevant legal systems.
