人民调解制度在社区纠纷化解中的问题研究

摘　　要：随着社会的发展,社区纠纷也呈现出复杂、频发等特点,当司法资源无力应对时,非诉讼纠纷解决方式逐渐被人们所重视。人民调解在我国有着很好的文化和制度基础,又有着便捷、灵活等特点,在处理社区纠纷时有着天然的优势。本文以兰州市某街道近四年人民调解纠纷的实际情况为例,分析人民调解制度在实践中存在的不足,以及如何从提升调解协议效力认知、建立信任关系、人民调解职业化发展、增加专业调解机构、与其他部门建立有效衔接机制等方面完善该制度提出了相关建议。With the development of society,community disputes also show the characteristics of complexity and frequency.When judicial resources are unable to deal with it,ADR are paid attention gradually.People's mediation has a very good cultural and institutional foundation in our country,and has the characteristics of convenience and flexibility.It has natural advantages when dealing with community disputes.Taking the actual situation of people mediation dispute of a street in Lanzhou city in the past four years as an example,this paper analyzes the shortcomings of people mediation system in practice.And the author puts forward some suggestions and analyzes how to improve the system from the aspects of enhancing the cognition of the effectiveness of mediation agreement,establishing the trust relationship,developing the professionalism of people's mediation,increasing the professional mediation organizations,and establishing the effective connection mechanism with other departments.
