摘 要:海水养殖污染日渐成为海洋环境污染的新问题,其内源性污染一方面造成养殖水产品财产损失,另一方面造成渔业水域的环境损害,其在适用法律、法律性质与索赔主体方面存在复杂性。私益诉讼的索赔主体主要为“双证”齐全的养殖户,无证养殖户的索赔权应当受限,渔业互保协会非索赔的适格主体。公益诉讼索赔主体为代表国家的环境与渔业行政主管机关及特定情况下的农村集体经济组织,检察机关为补充主体,而环保组织非索赔主体。公益诉讼先行有利于海水养殖污染损害赔偿案件的解决,私益索赔主体可以通过检察院督促公益诉讼的行使。Marine aquaculture pollution has become a new problem of marine environmental pollution. On the one hand, endogenous pollution causes property loss of farmed aquatic products, and on the other hand, it causes environmental damage in fishery waters. It has complexities in applicable laws, legal nature and claims. The claimant of the private-sum lawsuit is mainly a complete “double-certificate” farmer. The claim right of the unlicensed farmer should be limited, and the fishery mutual insurance association is not the eligible subject of the claim. The main body of the public interest litigation claim is the environmental and fishery administrative authority on behalf of the state and the rural collective economic organization under specific circumstances. The procuratorial organ is the supplementary subject, and the environmental protection organization is not the claimant. The public interest litigation is firstly beneficial to the settlement of civil aviation pollution damage compensation cases, and the private benefit claim entity can urge the public interest litigation to be exercised through the procuratorate.
