摘　　要：回顾新中国成立70年来我国体育法治制度建设历程:新中国成立初期以"国民体育"为核心,贯彻"普及与提高相结合"的方针;改革开放历史时期在举国体制、奥运战略、体育大国等背景下开展制度建设,《体育法》颁布,体育法律体系逐步形成;新时代在全面深化体育改革及全面推进依法治体、全民健身战略和健康中国战略、体育强国战略背景下开展制度建设.70年来我国体育法治制度日渐完善,这得益于发展理念的不断更新:体育法治功能从"行政性"到"社会性";体育法治宗旨从"义务本位"到"权利本位";体育法治价值从"注重秩序"到"秩序与自由并重";体育法治手段从"单一"到"多元";体育法治概念从"法制体系"到"法治体系".Looking back on the construction of the sport legal system in China since the founding of the People’s Republic of China seventy years ago: in the early days of the founding of People’s Republic of China,“national sports” was a core to develop, and guiding by the ways of “popularize sports to the public and improve the overall level on sports”. In the period of the reform and opening up, institutional construction was carried out under the background of the whole nation system, Olympics and major sports power. Law of the People’s Republic of China on Physical Culture and Sports was promulgated, which represents the establishment on China’s legal system. In the new era, the system construction is carried out with the background of deepen reform, advance law-based governance, the national fitness strategy, as well as healthy China strategy and sports power strategy. Over the past 70 years, the rule of legal system of sport in China has been gradually improved, which is attributed to the innovative idea during development: the rule of law function of sport has changed from “being administrative” to “being practical”;targets changed from “duty” to “right”;the value changed from “focusing on order” to “focusing on both having order and freedom”;the methods changed from “single” to “diverse”;the concept changed from “legal system” to “law-based governance”.
