摘 要:在中国的行政实践中,人情是一种重要的结构性因素,其对中国行政实践与价值选择的影响,主要基于互惠逻辑、面子逻辑和伦理逻辑而得以展开。中国式的人情结构可分为两种类型,一类是在行政体系内部形成的、以行政体系内部不同主体间的交往为基础的业缘型人情;另一类是由行政体系与行政体系外部的社会性主体基于业务往来等而形成的互动型人情。人情对本土行政实践的影响,既可以表现为正面的主体激励,也可以表现为负面的腐败催化。根据情理法的不同优先性排序及情理法作为三种要素在“利”“义”设定中的功能之不同,可将行政交往关系分为“情感型交往”“工具型交往”与“理法型交往”三种类型。无论是对于中国还是西方而言,构建理法型行政交往模式,都应是努力的方向。In China's administrative practice,human relations (renqing) is an important structural factor.Its influence on China's administrative practice and value choice is mainly based on the logic of reciprocity,face(mianzi) and ethics.Chinese-style human relations structure can be divided into two types.One is formed within the administrative system,based on the interaction between different subjects within the administrative system;the other is formed by the interaction between the administrative system and the social subjects outside the administrative system based on business contacts.The influence of human relations on local administrative practice can be manifested as either positive subjective incentives or negative corruption catalysis.According to the different priorities of human relation,reason and law,and the different functions of the three elements in the setting of "interest" and "duty",administrative communication relations can be divided into three types:"affective communication","instrumental communication" and "rational-law communication".Both for China and the west,the construction of "rational-law" administrative communication mode should be the direction of efforts.
