摘　　要：权利要求是审查、无效、保护等不同法律程序中利益方关注的焦点,申请文件撰写的优劣一定程度上取决于权利要求是否能够凸显发明的创造性。本文从三个化工类案例出发,基于作者对专利法第二十二条的认识尝试提出权利要求撰写和答复时面临的创造性难以凸显问题的解决方案。The claims are the focus of interest in different legal procedures such as examination, invalidation, and protection. The quality of the application are determined to some extent depending on whether the claims can highlight the inventive step of the invention. Based on the three chemical cases, this paper attempts to propose a solution to the problem in writing and answering office actions based on the author's understanding of Article 22 of the Patent Law.
