摘 要:本文从制度初创、取消、恢复和探索、建立和发展、整合与加强等五个阶段描述了新中国成立70年以来劳动人事争议处理制度的演进历程;以调解和仲裁为重点,总结改革开放以来,在法律制度建立完善、劳动人事争议案件化解、基础建设和能力建设等方面取得的成就;以及坚持多元处理、改革创新、调解优先和仲裁独特优势等重要经验。本文认为,目前我国劳动人事争议处理制度运转良好,体制机制和工作中虽存在一些问题,但并无重大制度缺陷;应在保持现有“一般案件一裁两审,部分案件一裁终局”制度框架不变的前提下,通过制度完善和机制创新来充分发挥现有争议处理制度的优势,切实维护劳动人事关系的和谐与社会稳定。This paper describes the evolution of the labor and personnel dispute resolution system since the founding of the P.R.C, which includes f ive stages of system initiation;cancellation, recovery and exploration;establishment and development;integration and strengthening. Focusing on mediation and arbitration, this paper summarizes the achievements made since the founding of the P.R.C, especially since the reform and opening up in establishing and improving the legal system, resolving labor and personnel disputes, and the improvement of infrastructure and capacity. It extracts some important experiences such as persisting in multi-processing mechanism, persisting in reform and innovation, persisting in the priority of mediation and persisting in the unique advantages of arbitration. This paper argues that the existing labor and personnel dispute resolution system in China works well, there are no major institutional defects. The article believes that the existing institutional framework should be kept unchanged, and the advantages of the existing dispute resolution system should be given full play through the institutional improvement and mechanism innovation, so as to effectively maintain the harmony of labor and personnel relations and social stability.
