谦抑性视野中经济法理论体系的构建研究

摘　　要：随着改革开放以来,我国经济体制也发生了重要改革,目前市场经济成为了我国主要的经济体制,为了让市场更好的发挥其主体性作用,国家应该尽量小范围内进行干预,控制。法律的谦抑性是指在不依靠法律的情况下达到比法律手段更好的效果,在经济法中也体现为依靠市场的经营规律来保障市场经济的稳步发展,因此本文浅要分析了从谦抑性视野中构建经济法理论的相关资料。with the reform and opening up,China's economic system has also undergone important reforms.At present,the market economy has become the main economic system in China.In order for the market to play its subjective role better,the state should intervene and control as small as possible.The humility of the law means that it can achieve better results than the legal means without relying on the law,and it is also reflected in the economic law to rely on the operating laws of the market to ensure the steady development of the market economy.Therefore,this paper briefly analyzes the relevant data of constructing economic law theory from the perspective of humility.
