大保护背景下的长江水权问题探讨

摘　　要：长江水资源的开发利用推动了长江经济带发展,但也造成了长江水资源污染、浪费和破坏日益加重。修复长江生态环境、生态优先、绿色发展是今后长江经济带发展的目标。科学的长江水权制度是实现这一发展目标的重要保障之一。在“共抓大保护、不搞大开发”的背景下,根据长江流域的自然条件、人口及经济发展状况,科学界定水权,明晰长江水资源所有权性质及行使主体,加强水资源使用权法律规制、政府监管和市场机制建设,充分发挥水权在优化水资源配置、提高水资源利用效率、促进水资源合理利用和保护长江水生态环境等方面的作用,实现在保护中利用、在利用中保护。The development and utilization of water resources of the Yangtze River has promoted the progression of Yangtze River economic belt,but it also led to pollution,waste and damage of water resources of the Yangtze River.To restore the ecological environment of the Yangtze River,green development should be taken as the priority and a scientific Yangtze River water rights system should be one of the important guarantees to achieve this goal.In the background of joint protection and cautious exploit,we should take natural conditions,population and economic development of the Yangtze River basin into consideration,scientifically define water rights,clarify the ownership property and the rightsubject,strengthen the legal regulation on utilization rights of water resources,government regulation and construction of market mechanism,bring the role of water rights into a full play in optimizing water resources allocation,improving the efficiency of water resources utilization,promoting rational use of water resources and protecting the ecological environment of the Yangtze River.Thus,we can utilize water resources and protect them in the meanwhile.
