摘 要:始自2016年的公平竞争审查制度,进一步提升了行政主体的反垄断意识,彰显了政府在维护统一市场和竞争有序的市场经济方面的职责所在,标志着我国竞争政策基础性地位的确立,也意味着反垄断法律制度的进一步完善。该制度确立以来,从国家层面到各省市,都围绕之予以贯彻。但从实际看,无论内涵认识还是审查机制,公平竞争审查制度亟待进一步加强和改善。The fair competition review system, which began in 2016, has further enhanced the anti-monopoly consciousness of administrative subjects, highlighted the responsibilities of the government in maintaining a unified market and a competitive and orderly market economy, marked the establishment of the basic position of China's competition policy, and also meant the further improvement of the anti-monopoly legal system. Since the establishment of the system, the system has been implemented from the national level to all provinces and cities. However, the fair competition review system needs to be further strengthened and improved, regardless of its connotation or review mechanism in practice.
