摘　　要：近年来,司法不公成了一个热门话题,监督是各级人大的一项重要工作,个案监督则是多年来地方人大及其常委会在实践中探索、创造的一种监督形式,司法机关由于各种原因,特别是法院会办错案造成个案的不公正、不正义。人大的法定职权决定了它与社会生活在细节问题上的相对超脱,因而与那些阻力重重的个案往往没有利害关系。这使人大获得了对个案进行监督的道义上的特殊优势,从而实现案件结果的“真实”、“公平”、“正义”。In recent years,judicial unjustness has become a hot topic.Supervision is an important task for People's Congress(PC)of all levels,and supervision of individual cases is the result of study and creation of local PC and its standing committee.Due to different reasons,judicial offices,especially courts,may make mistakes in handling a case,and result in unjustness.PC's legal powers makes it free of trivial matters in social life and has no interests in obstructed cases.This enables PC in morality to supervise individual cases,and ensure truth,fairness and justice of cases.
