摘　　要：我国文化资源丰富,对那些具有开发潜质的文化资源,在保持其自身特点、文化特色前提下,可考虑与科技创新、现代社会融合发展,生成创意产权,发展文创产业。文化资源产权、创意产权的交易流转,是以文化授权的方式开启文化资源向文化符号、文化资本转化的文创产业链。有必要围绕文化授权前的文化资源产权发掘与确认、文化授权过程中的产权交易监管、文化授权后的文化资源权益再造等环节,强化文创产业生产经营的产权激励制度,设计具体的法律保障举措、跟进规则,规制文化产权交易流转,保护文化创意,提高产权交易主体交易活动积极性,推动文化产权有序流转,促进文创产业发展。China is rich in cultural resources.Therefore,under the premise of maintaining his own cultural identities and characteristics,cultural resources can be integrated with technological innovation and modern society to develop the creative intellectual property as well as creative cultural industries when we exploit the potential cultural resources.And the transaction circulation of the intellectual property of cultural resources and ideals has built an industrial chain of creative cultural resources,transferring the cultural resources to cultural symbols and capital in the form of cultural authorization.So it is necessary to focus on three parts:the excavation and confirmation of cultural resources before authorization,the supervision of property transaction during cultural resources authorization as well as the rights and interests of cultural resources after the authorization.Also,it is vital to regulate the property incentive system of the creative cultural resources industries in production and operation,design specific legal guarantee measures,follow the rules and regulate the exchange of cultural property to protect cultural creativity,inspire the enthusiasm of the property transaction,promote the orderly circulation of cultural property and facilitate the growth of creative cultural resources industries.
