摘　　要：针对图书馆数字化利用馆藏绝版作品遇到的版权问题,欧盟在最新立法中采取延伸性版权集体管理制度予以规制,该制度不仅进一步协调了欧盟成员国的图书馆版权政策,而且具有公益导向、降低版权授权成本以及保护权利人权益等特征,同时增强了图书馆利用作品行为的法律确定性,减少了图书馆面临的侵权责任风险,这对我国完善图书馆版权制度有着积极的借鉴意义。In view of the copyright problems encountered in the digital exploitation of out-of-commerce works in libraries,the European Union has adopted an extended collective licensing(ECL)in the latest legislation to regulate them.ECL not only further coordinates the library copyright policies of EU member states,but also features public interest orientation,reducing copyright licensing costs and protecting the rights and interests of rights holders.At the same time,it has enhanced the legal certainty of the use of works by libraries and reduced the risk of infringement liability faced by libraries,which has positive reference significance for improving the library copyright system in China.
